Your access to the Exambiz website

This website is owned and operated by Exambiz Pty Ltd (ABN 94 004 429 672).  Your access to this website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Exambiz Web Site (known collectively as ‘Terms and Conditions’). Your use of, and/or access to, the Exambiz Web Site constitutes your agreement to the Terms and Conditions. Exambiz reserves the right to amend the Terms and Conditions at any time. Periodical review of the Terms and Conditions should be made, because they are binding on you.

Restrictions on the use of the Exambiz Web Site

You may not:

  1. Copy, modify, create a derivative work from, reverse engineer, reverse assemble or otherwise attempt to discover any source code in the Software;
  2. Frame, link all or a portion of the Site or the Content, reproduce, duplicate, re-transmit, disclose, republish, filter, alter, distribute, copy, sell, resell, or exploit for any commercial purposes, any portion of the Site, any Content, or access to the Site, without express written consent of Exambiz;
  3. Use web-accelerated browsers or products, or other applications that are capable of copying large portions of Content from the Site;
  4. Use any device, software, routine or the like to interfere or attempt to interfere with any Site functionality;
  5. Upload any material which contains a virus, or other harmful or potentially harmful code;
  6. Use any e-mail addresses appearing on the Site for purposes not relating specifically to the Site; or
  7. Access the Site by any means other than through the interface that is provided by Exambiz, or attempt to access any area of the Site to which your access is not authorised.
Links to Other Sites

The Web Site contains links to third party web sites. These links are provided solely as a convenience to you and not as an endorsement by Exambiz of the contents on such third-party Web sites. The Company is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party Web sites. If you decide to access linked third-party Web sites, you do so at your own risk. 

Exambiz is an independent company and references to other companies or universities do not necessarily imply any partnership, joint venture, or other legal connection.

Limitation of Liability

To the maximum extent permitted by law Exambiz, its officers, staff, contractors and its third party suppliers exclude all liability to any person for any loss (including loss of revenue or anticipated profits, loss of goodwill, loss of business, loss of data, computer failure or malfunction), or injury or any direct, indirect, consequential, special, punitive, or other damages arising from or relating in any way to the content and/or any use of the Exambiz Web Site. Where any law implies a warranty into these terms of use which may not be lawfully excluded, then to the maximum extent permitted by law, Exambiz’s liability for breach of the warranty will, at Exambiz’s option, be limited to the re-supply of the relevant service or the payment of the cost of having that service re-supplied.

You agree to personal information about you being handled in accordance with:

  1. the Exambiz privacy policy;
  2. any policies, directions, statements or agreements on the Site;
  3. these terms and conditions; and
  4. the regulations and procedures of relevant universities.
  
Terms of Purchase

General purchase conditions of the site are stated below.  However it is the responsibility of the student to read any purchase conditions that from time to time may be specific to services sold on this site.  If the registration and/or booking is conducted by another person on behalf of the student, the terms and conditions are construed to be understood and accepted by the student.

Service Limitations

Exambiz invigilate written exams only.  We can not invigilate language exams requiring a tape recorder, or on-line exams requiring computer access.  Exambiz do not undertake to offer invigilation for students of any particular academic university as University policies govern the approval of Exambiz to conduct invigilation.  On occasions, venues may not be available.  Therefore, Exambiz do not undertake to offer exams at any particular venue in a study period.  Further:

  • We reserve the right to refuse registration and/or booking of exams for any student.
  • We reserve the right to refuse a student's registration should insufficient information be supplied as required by the website.
  • We reserve the right to refuse a student's exam booking if any payment is outstanding to Exambiz from previous exams, or fees incurred by Exambiz as a result of previous booking arrangements with the student are  outstanding.
  • We reserve the right to refuse entry to an exam room if the relevant email booking confirmation displaying the exam booking can not be shown to an inviglator.
  • We reserve the right to refuse entry to an exam room if a student arrives more than 30 minutes after the exam commencement time.
  • We reserve the right to retain a completed exam (including all script books) in safe keeping should payment be incomplete or until payment for the exam has been verified.
  • We reserve the right to confiscate materials improperly used in exams, and forward them to a University in accordance with University exam policy.
Conditions of Booking

Students need to complete the booking process with Exambiz no later than the close of business, ten (10) calendar days prior to an exam date.  Note: bookings are NOT POSSIBLE once an exam is closed.  This process includes the booking and verification of payment completion.  Any bookings received within the 10 day period will be prevented on the Exambiz website.  Booking and payment is not transferable to other students or to any other exams for a student.

Note that some universities may charge you a late handling fee if they receive your examination invigilation advice after their due date.  Exambiz will not accept responsibility for any delay incurred to a student's exam booking which results in a late handling fee being charged by the university to the student.

Notification to students

Once a student has completed booking and payment for any exam(s) with Exambiz, we will, using the email or postal address  supplied by the student, notify the student in writing (by email or letter).  This notification will indicate the location, date and time of any exam(s) for which the student has booked with Exambiz, as well as provide payment and receipt information.  Exambiz endeavours to invigilate the exam(s) at the location, date and time indicated.  However, we also reserve the right to cancel or postpone an exam to an alternative date.  If Exambiz cancels or postpones an exam, we will notify any students booked for that exam.  If an alternative date can not be agreed, we will refund the entire payment for that exam without deducting an administrative fee.  If a student cancels, defers or withdraws from an exam, a partial refund may be given in accordance with the Cancellation and Refunds Policy. 

Invigilation rates

All invigilation rates and any applicable postage rates are subject to change at any time.  A current invigilation rate schedule appears within this website.  These rates are available for perusal prior to students booking for any exams invigilated by Exambiz.  Rates are in Australian dollars and include GST.  Additional invigilation rates may apply for accepted one-on-one invigilation. If postage is required, an additional fee will be added to the rate.

Payment Terms

Payment must be received by Exambiz at least ten (10) calendar days prior to an exam date.  In the absence of credit line, payment shall be made by cheque or money order, or by an alternative arrangement approved by Exambiz.  If a student fails to make payment through whatever means, by the due date, or should payment be stopped by a student or a financial institution, then without prejudice to any other right or remedy, Exambiz shall be entitled to:

  1. Reject the student’s booking for invigilation, or
  2. Accept the booking but charge a penalty fee not exceeding 50% of the appropriate exam invigilation rate published on the website
  3. Apply additional charges to recoup declined credit card transaction fees and/or bank fees incurred.
Cancellations and Refunds

Cancelling a booking and seeking a refund

If you are unable to sit an exam, you should contact your university.  You should also cancel a pending or confirmed booking with Exambiz.  Note that invigilation fees are not transferable to other exam bookings.  If you wish to cancel a confirmed booking, you may apply on-line for a refund of your payment (less $20 administration fee per exam), subject to the following:

  • A refund will be made provided that you advise us yourself, by cancelling the exam booking on-line at least 48 hours prior to the exam.
  • Exams booked in error, will also be liable for the $20 administration fee.
  • No refund is available if you have not met the above condition.

How to apply

  • To cancel an exam booking and apply for a refund, first you need to log in to the system.  Then go to 'Check my Bookings', and select the exam(s) you wish to cancel. 
  • If you paid by credit card, we will refund the balance of your payment to the same credit card.
  • If you paid by money order or cheque, you will have an opportunity to complete a small form which is submitted to us.  The form will ask you for an Account Name, Account Number and BSB Number.  After receipt of this advice, we will transfer the balance of your payment into your nominated savings or cheque account. 
Conduct at the exams

Note that invigilators are not permitted to offer advice or interpret the content of any exam.  In the event of a situation requiring clarity or interpretation, students should make a notation on the exam paper and resolve the issue with the university. 

By booking an exam with Exambiz, a student agrees:

  1. to comply with all directions and instructions given by an invigilator in relation to an exam
  2. to behave in a manner conducive to exam conditions as determined by universities or similar academic institutions
  3. not to disrupt another student during the exam by communicating directly or indirectly or passing materials between him/herself and another student
  4. not to remove any exam related materials from the exam room without express permission from an invigilator
